New Zealand dentist guilty of sex-case charge

The New Zealand Dentists Disciplinary Tribunal found a dentist guilty of professional misconduct over a 2001 incident in which he forced a female patient to touch his penis while she was sedated. Two similar complaints against the dentist, relating to incidents in 1984 and 1989, were not upheld because of lack of proof.

The dentist claimed in his defense of the 2001 charge that the sedative caused sexual hallucinations in his patient. The tribunal rejected this claim as “unlikely” and said the woman involved in the 2001 charge was a “credible witness”, while the dentist’s evidence was “less compelling”.

The name of the dentist has not been released and he is still practicing dentistry. The tribunal can stop the dentist from practicing and impose a fine of up to $5000. The dentist can also be ordered to pay the tribunal costs, which could be about $80,000 for the six-day hearing.

The decision on the penalty is expected in the next few months.
