Update: $2 Million for 16 Teeth

New details have come out about the court case involving the Sexton Dental Clinic and the woman who sued them and won $2 Million for having all of her upper teeth extracted at the clinic (read the story here).

Sexton Dental Clinic’s CEO, Ruan Westraad, today told the clinic’s side of the story.

The 28-year-old woman went to the dental clinic in 2006 because of a cracked tooth. The woman first saw Dr. Robert Jamison, who recommended that she have all of her upper teeth removed (due to extensive decay) and then get fitted for a full upper denture. The patient stated that she could not afford all the extractions, so Dr. Jamison recommended removal of only 10 teeth and leaving six around which to secure a partial denture (even though those six teeth were not in good shape).

Dr. Robert Scott, who was to perform the procedure, determined that the remaining teeth would not sustain the partial for very long, and he, too, recommended that all the upper teeth come out. Dr. Scott then told the woman, “Today, we’re going to extract all your upper teeth,” according to Westraad, and when she did not turn him down, he went ahead with the surgery under local anesthesia.

The woman was fitted for a full upper denture the day after the initial surgery. She actually wore this dentures during her depositions prior to the trial. In addition, Westraad emphasized that on subsequent visits to the clinic she never complained about any of the work performed there, including the extractions.

This week, lawyers for the clinic filed a motion for a new trial. The judge’s decision on the motion is expected September 8.
